Regulation on the Launch of the “Applying at One Window, Getting the Result on the Spot” Service for Existing Home Transaction, Taxation and Registration

The authorities of all districts, counties (autonomous counties), the Liangjiang New Area ,Wansheng  Economic and Technological Development  Zone in charge of planning & natural resources, housing & urban-rural development, and taxation, as well as the affiliated entities and offices of Chongqing Municipal Bureau of Planning and Natural Resources, Chongqing Municipal Commission of Housing and Urban-Rural Development, Chongqing Municipal Tax Service, State Tax Administration:

In order to further advance the comprehensive reform in real estate registration across this Municipality, improve the convenience-orientated and pro-business services for  real estate registration, and develop a market-oriented, law-based and international business environment, the Chongqing Municipal Bureau of Planning and Natural Resources, Chongqing Municipal Commission of Housing and Urban-Rural Development and Chongqing Tax Service, State Taxation Administration have made the decision to jointly launch the “One-Counter Service and On-Spot Result Delivery” service to facilitate the transaction, registration and taxation of existing housing properties.

I. Objectives

The objectives of the work hereunder are: in accordance with Regulations on Optimizing the Business Environment, integrate the relevant service counters under the real estate  registration agencies, real estate transaction regulatory authorities and taxation authorities into comprehensive counters providing services across the board encompassing real estate registration, transaction and taxation, and promote the service of  “One-Counter Service and On-Spot Result Delivery” for the registration, transaction and taxation of existing housing properties, so that after the applicant submits his/her/its application materials that meet all relevant requirements to a comprehensive counter and pays all relevant taxes and fees, the applicant will receive the real estate registration results on the spot, thus making the application process more convenient.

II. Specific Measures

All local authorities in the districts and counties of this Municipality shall ensure the actualization of the service through a series of measures, including setting up comprehensive service counters, streamlining the collection of required documents, and shortening the processing time.

1. Adjusting service counters

The authorities responsible for real estate registration, housing & urban-rural development, taxation shall jointly set up comprehensive service counters. At such a counter, the applicant will undergo a one-stop procedure incorporating real estate transaction, registration, tax appraisal, tax payment, tax payment registration, and collection of  certificates of title.

Local authorities can decide on the number of such  counters flexibly on the basis of local conditions, provided that the demands of the “One-Counter Service and On-Spot Result Delivery” service are properly met. Efforts shall be coordinated  to staff such comprehensive counters -- the personnel can be mobilized from the local real estate registration centers, or real estate transaction centers, or tax services.

2. Streamlining the collection of required documents

The collection of required documents for real estate registration, transaction and taxation must be further streamlined. Staff working at the comprehensive service counters are not allowed to demand the applicant to submit any documents that are not specifically required by the law, official regulations or rules. If a document is needed by the three parties -- real estate registration, housing urban and rural development and tax service -- the applicant only needs to submit one copy thereof to the comprehensive service counter, and the document shall be copied and archived by the parties requiring it. If the original document is required for on-site verification, the comprehensive service counter staff may not ask the applicant to provide duplicates; instead, they shall make copies of the original document themselves.

A list of the application documents required for real estate registration,transaction and taxation as well as rate of service fees shall be displayed on the official websites of Chongqing Municipal People’s Government and the official websites of relevant departments as well as in the real estate registration halls.

3. Shortening the processing time

In principle, processing of an application for registration of existing housing property (including both residential and non-residential properties) transfer (including incidental matters of mortgage and transfer registration) submitted to the comprehensive service counter by an enterprise or an individual shall be completed on the spot, except for  any of the following circumstances:

a. Where a public announcement (display) thereof is explicitly required by any law or regulation;

b. Where one or more of the required documents are not provided;

c. Where the applicant raises any objection to any item under processing.  

III.Requirements

All local authorities of the districts and counties shall understand the significance of optimizing business environment, advancing the comprehensive reform of real estate registration in this Municipality, and shall step up the process of upgrading administrative concepts and methods and improving service capability and efficiency.

A. Ensuring effective and proper organization and implementation of relevant work.

All local authorities of the districts and counties shall timely report to local  CPC committees and governments to get their support. The local authorities are also required to learn from each other to improve the work and put “One-Counter Service and On-Spot Result Delivery” as their priorities, improve their organization and guidance of relevant work, and ensure that all duties will be properly fulfilled..Relevant municipal authorities must, on the basis of their respective functions and duties, inspect and supervise the implementation of the work at the local level.

B. Enhancing coordination.

The local bureaus of planning and natural resources, commission of housing and urban-rural development, tax services, and real estate registration centers shall cooperate with each other to advance the work hereunder in a coordinated manner to achieve deep integration of the three departments.

C. Pushing forward with internal staff training and external publicity.

In view of the fact that time is pressing and the workload is heavy, all local authorities shall carry out proper internal training and external publicity, so as to ensure that their staff will master the new business procedures required by this new service. The procedures of this new service shall be displayed in a readily visible and accessible manner in the service halls, either in the form of physical displays or video demonstrations, so that the public can access relevant information easily. It is necessary to use local mainstream media to promote this new service and ensure that the public and professional agencies be informed of the progress of the work hereunder.

D. Improving the communication channels

Local authorities shall timely collect typical cases and experiences and report to higher level authorities. Major issues arising from implementing the work hereunder and important public opinions shall be reported to the higher level authorities, the local government and the local CPC committees in a timely manner,  so as to avoid any problem with public opinion triggered by major changes in business procedures brought about by this new service.

This Circular shall become effective as of the date of issuance thereof.
